Our client was injured in a collision in Henrico, Virginia. She was a passenger in a vehicle driven by her daughter. They entered an intersection with a protected green light and were making a left-hand turn when they were struck. An independent witness said that the driver of the second vehicle was at fault, and the officer charged him with failure to obey the traffic signal.

Paramedics found our client unresponsive at the scene and attempted to revive her using sternal rubs and nail bed pushes. They also placed her in a cervical collar. She was transported to UVA Hospital’s emergency room after losing consciousness for seven minutes. Ultimately, she regained consciousness during her transport to the hospital after exposure to an ammonia inhalant.

Initial Effects

According to initial evaluations, the victim sustained a concussion, a contusion, lower back pain, and a closed-head injury. Doctors treated her body aches and dizziness and subsequently diagnosed her with a body sprain and strain. At a concussion clinic, doctors determined that our client was experiencing difficulty with concentration, dizziness, and conversation. She was prescribed Elavil, naproxen, and physical therapy.

The victim received treatment throughout 2014, during which time she reported a dramatic decrease in her headache pain. Unfortunately, her concentration had not improved. In January 2015, our client reported numbness throughout her left arm and left leg. A neuropsychologist performed a medical exam and concluded that her medication had not helped as expected. However, the neuropsychologist did note that our client’s PTSD had vastly improved, at which time the doctor reinstated her driving privileges.

Long-Term Outcomes

Due to the number of injuries our client sustained, her driver’s license was suspended and she was unable to return to work, resulting in $29,000 worth of lost wages. She also incurred over $43,000 in medical expenses.

According to her neurologist, the brain injury caused a number of permanent symptoms, including:

The Result

Because our client was a passenger in the vehicle involved in the accident, she was required to sue both drivers. Fortunately, an independent witness testified that the driver of the second vehicle was not protected under the light signal and was predominantly at fault for the collision. Officers on the scene supported this notion and charged the other driver with failure to obey a traffic signal.

Using this information, we were able to secure $525,000 for our client’s medical bills, lost wages, and pain and suffering.
